Not only is she NOT ALLOWED to physically handle the child like that, but shaking a child like that can fuck up the kid by trauma to the brain. The brain is floating in liquid within our craniums and if shaken too hard, can sustain brain trauma resulting in brain damage.

It was wrong for her to do that, since she is not the parent. However, I don't think it is criminal, since she did not call him names or beat him. It is very difficult for a teacher to deal with children that come from homes where respect, consistency, and discipline are either non-existent - or poorly modeled. She did her best considering this child may be a repeat problem.
