I am uncertain of the laws, but something about this does not seem right. Clearly the driver should have been more cooperative, but the cop refused to tell him how fast he was going or why he was being cited. I am not sure I would have signed that damn ticket either. The cop seemed like a rookie, and became agitated very quickly. He just did not handle the situation very well. Is there any more information on this story?

I'm sure there is more to the story as the video has been edited. The citation usually states the posted speed limit and the speed the violator is accused of traveling. The driver was wrong and was refusing arrest. However I think the police officer was quick to taser him. I believe the driver does not understand how the citation process works and thought that if he signed it he was admitting guilt. Tough way to learn a lesson.

Up here in Canada the Taser has been in the news because a man from Poland was killed after being Tasered. There has been 18 deaths attributed to the Taser in this country alone. The device is not being used correctly by cops as it's supposed to be used as a self defence device only. In this video the guy in the truck was not being aggressive to the cop and in actuality had his back turned to the officer when he was shot.
Hopefully there will be an investigation and the officer will be dealt with accordingly.

Trooper told driver he was in a construction zone or something like that, and pointed out the flagged 40 MPH sign that you can see in the very beginning of the vid. Apparently the guy in the SUV came up at a high rate of speed behind the trooper and thats what prompted him to stop him. But yes, bad attitude on BOTH sides of the fence here, WTF?
Tazing this guy was overboard IMHO. You already have his ID and vehicle papers, its not like he is going anywhere and you can't find him if he does take off. Explain to him that he faces arrest for refusing to sign and if he wants to be an ass and refuse to sign the ticket call for backup and handle it when they show up. Tazers are supposed to be for active physical resistant subjects, not every dickhead that wants to challenge your authority.

You're a complete idiot. If you didn't notice over the loud ass noise of the cars going by, the driver of the speeding car was very agitated and uncooperative. If an officer asks you to put your hands against the car, you do it, he isn't doing it to arrest you, especially in this case, but for his safety from an agitated suspect who is prone to outburst. He tased him because he was rushing back to the car either in an attempt to flee, or an attempt to be a stubborn asshole and waste more of the officer's time. If you refuse to sign the ticket, you waive your right to pay the set fee of the ticket and instead you go to court in an attempt to get it overruled.
In other news, this guy was an absolute idiot, he was saying that there was no 40 mph sign when in fact it's the first thing you see in the video. First mistake was not telling the driver what he is being arrested for and second, not reading him his rights even after the driver begged him to do so. And, when you sign a ticket it is for promise to appear not to admit guilt. Better check the law and your rights before you make un-educated comments about this video.

Tickets are called citation in lieu of arrest. That means sign it and off you go to fight in court one if you so desire. Don't sign it and you are arrested on the spot. Driver was being a uppity prick who was starting to walk back to his vehicle. Rule #1 in law enforcement: Never debate with someone you are going to ticket. Tell them what the violation is and when to appear in court..end of story. Why should the cop have to end up wrestling with the guy on the edge of busy highway? Taz him and be done with it.

Where is everyone coming up with he should have been read his rights? Miranda rights apply only when police question you, or is used to warn people not to self incriminate themselves during questioning.
Lastly how do you know the cop didn't tell the driver he was speedy. There was conversation going on when all the vehicles drove by drowning out their words. One part I did hear was the driver mentioning the 40mph sign, so he was aware he was being accused of speeding.

well a ticket is not an admission of guilt, it is given instead of arrest, which the officer could have done. The search was fully justified because after you make an arrest probable cause is no longer needed to search anyplace where the suspect had access during the commiting of the crime. The officer also does not have to read a person their rights when arresting them unless they are asking them incriminating questions which this officer was not doing. Im not saying that the officer shouldnt have taken more time to explane himself to the man, but the man should have done what he was told. He can have his day in court and if the officer really was in the wrong it will get fixed there. If all of these cops are always "power tripping" then why do you hardly ever hear that a cop is being punished for unneccesary force? Ya it happens but not every time one of these hundreds of videos are posted, so that must mean that these officers are staying within the limits set for them by the state and federal laws, huh?

Another case where someone thinks they know their rights because they watch too much TV and that makes them a shit house lawyer. If the dumb ass had just listened to the police officer he could have filed a complaint and or fought this in court. The dumb ass turned an already hazardous situation, (being stopped on the side of an highway), in to a down right deadly situation by causing him self to be tasered. I do not believe the guy would have complied if the officer would have placed hands on him and that would have put you in the middle of the highway fighting this guy. Maybe a few more warnings, but the guy was clearly turning away heading towards the drivers side of his vehicle, what are you supposed to do let him drive off. maybe a little work on his verbal persuasion, but all and all i believe a good shoot.

In my city, the cops don't even bother with the tazers, they like to shoot people and get a "paid" suspension.

As a matter of Fact, i was on the streets ''today'' and there was some elder guy standing near the intersection with a sign sayin that tazers shud be Band from this planet since they're soo harsh. And NO! he was not a crazy man. He was kind of like a protester or something trying to make a difference in life. if the populations of baning tazers grow, then they're thinkin of making a website about them .its hard to make a judgement, u see tazers DO help stop crime..but Guns r alot worse then tazers

Whether the guy was right or wrong is irrelevant, the fact remains that the officer did not read him his rights,(Proof on camera) and based on that fact, it has to be dismissed in a court of law, and the officer reprimanded for poor performance. The fact is he asked a simple question and as a Police Officer he should have had the decency to answer it. He did use excessive force, it was not warented or required. Another case of Inflated Cop Ego Syndrome, not uncommon in Law Enforcement.

You do NOT have to have your "Rights" read to you if you arrested. Only if you are questioned for a violation of the law punishable by imprisonment. That is a common min-conception. The guy has the option of signing the citation, which is just an agreement to appear in court if he wishes to contest the charge or going to jail (arrested) and posting a bond that he will appear in court.

if the guy would have listened in the first place he would be home. the guys a moran trying to be smart. "whats my speed" oh well thats what he gets. I speed alot have alot of tickets. #1 rule dont talk back. it works. sometimes you even get off with a warning....

Super great use of a taser....The Officer did not have to read Miranda Rights because he was not being questioned for a crime...he was being given a citation for speed.
Secondly, It is easy for your folks to say I would this or that when you've never done the job so don't make statement that you do not know about...it makes you look obtuse!
Third, When this dumb ass refused to sign the citation, an officer has the right to effect an arrest...when you refuse our directives to stop and turn around and you don't, that normally means that you are either a dumb ass or you're going to fight us! I would have Tazed the dumb ass too. There are too many people out there that are not afraid to put a "cap in your ass".
I'm going home at nite to my family...I will not take chances. If you're given a directive follow it, if you do not agree fight us in court...don't be a dumb ass like this...."Don't do drugs"!

I don't think I would last long as a cop because I would be too aggressive towards junkies as I believe they deserve everything they get. I don't say that just for no reasons. You know it yourself, that junkies are the most unpredictable individuals on earth and they could snap with superhuman strength at any moment, hense the need for a sidearm or taser.

Thank you Kaos for your vote of confidence! It does take a lot of patience to deal with aggressive individuals. It is so important to not loose your head or get too angry at other people loosing their cool! That is when the officer uses too much force.

This video is a great example of how flawed the police
acceptance screening is. The are so many mentally handicapped individuals, like this man, that are allowed to carry a weapon and just generally fuck with people.
For instance I live in Canada, and in most provinces here they will overlook certain screening processes if you are of Native descent. I looked into it and because of this I would easily qualify for either RCMP or city police. NOT A GOOD THING!

He should of moved them both to the right side of the cars in case a drunk driver or something smashed them, it happens a lot. The mistake the dude made was being bitchy to the Cop, always be polite with officers so you don't get fucked, it's their job to fuck you. Know your rights, but make your complaints in court, you gota a lot better chance of winning an argument in court with a lawyer on your side than on the side of a road with a ego tripping cop.
